You can theyre called editorial placements, or as we in media relations like to say free advertising. Newspapers and magazines live and die by their content. If people dont want to read what theyre printing, theyre in trouble. Being able to offer a print publication (or even a broadcast network) with a story that will entertain, educate, or inspires its readers is a challenge, but well worth it if its printed. Which of the following newspaper placements do you think will garner more public response: an ad placed in the weekender or volunteer opportunity sections describing your organization and asking for donations; or a touching feature story about how the organization is making a difference in the community? Did someone sell their business to establish a womens shelter? Does a local mother care for homeless animals on her farm? Here are some ideas to help inspire you to develop a story for your organization or cause. Every person has a story.
Discover the stories behind the people in your organization and make the media aware of them. By story, I mean a simple, conversational story the type you might tell a friend. Pitching a story to the media doesnt mean you have to write it and offer it in its entirety. When you pitch a story, you simply let your media contact know about it. Theyll decide if its a fit and pursue it further. To get an idea of the kinds of stories the paper and local networks like, spend a few weeks tuning in or scanning the pages. It will be obvious the kinds of things theyre looking for. Pay close attention to the journalists and reporters who write on topics related to yours. These are the people you are going to want to contact with your story. Local outlets want local stories, and this can represent multiple opportunities for media coverage. For instance, if the person your story focuses on lives in a town other than where your organization is based, you can pitch the story to both locales. Let the world know whats happening.
Hosting or sponsoring an event can garner more attention than a two-line announcement in the calendar section. What is the story surrounding your event? If youre launching a clothing drive for professional attire to help women get jobs, highlight a success story, such as a woman associated with your organization who overcame hardships and landed a great job that changed her life. If youre hosting a casual fun-day dog show for kids to benefit a local animal shelter, find a pet owner who plans to enter his or her adopted shelter dog. Even your fundraising events can be promoted through editorial placements. You dont have to have a high-profile MC or a gala to make the news. If this is an annual event, how do you expect to surpass last years donations? How were the funds used? If they built a library or added a wing to a senior center, whats the story behind that? Announce Everything
Organizations in large cities face direct competition for donations and media coverage. To help improve your chances of media attention, do everything you can to stay in the news (or at least in the minds of the news writers in your area). Is there a staffing change or new hire (a positive one)? Announce it. If youve added a service to your organization, announce it. In sales and marketing, a consumer needs to hear about a product seven times before he or she will buy it, on average. The same is true for donations to non-profits. The more often the public sees your organization in print or hears about it on the radio or on television, the more likely they will be to consider donating. Keep that in mind the next time youve got news to share! Media relations is about building relationships and having an idea of what the public wants. Its not as complicated as it may seem, after all, you are the public. What do you want to read? What would be interesting to you? Talk to your co-workers and friends and find out their opinions. Identify the media people in your area who cover the types of things you and your organization do and begin to build a relationship. Before you know it, you may have them calling you for a story. By Gopu V. R. PATENT PROTECTION FOR SOFTWARE IN INDIA INTRODUCTION Patentability of the software- related inventions are very controversial in these days. In early 1960s and 1970s uniform response was that software was not patentable subject matter. But in subsequent years United States and Japan expanded the scope of patent protection. But several countries including Europe and India are reluctant to grant patents for computer program for the fear that technological progress in this volatile industry will be impeded. Proponents for the software patenting argue that patent protection will encourage, and would have encouraged, more innovation in the software industry. Opponents maintain that software patenting will stifle innovation, because the characteristics of software are basically different from those of the innovations of old Industrial, e.g. mechanical and civil engineering. PROTECTION FOR SOFTWARE RELATED INNOVATIONS WIPO defined the term computer program as: A set of instructions capable, when incorporated in a machine readable medium, of causing a machine having information processing capabilities to indicate, perform or achieve a particular function, task or result. Software can be protected either by copyright or patent or both. Patent protection for software has advantages and disadvantages in comparison with copyright protection. There have been many debates concerning patent protection for software as information technology has developed and more software has been developed. This caused mainly due to the characteristics of software, which is intangible and also has a great value. It needs huge amount of resources to develop new and useful programs, but they are easily copied and easily transmitted through the internet all over the world. Also due to the development of e-commerce, there is urge for patenting of business methods. Computer programs remain intangible even after they have actually come into use. There is a worldwide trend in favor of adopting patent protection for software-related inventions. This trend accelerated following the adoption in 1994 of the TRIPS Agreement, which mandates member countries to provide patent protection for inventions in all fields of technology, but which stops short of mandatory patent protection for software per se. Developing countries that did not provide such protection when the TRIPS agreement came into force (January 1, 1995) have until January 1, 2005, to amend their laws, if necessary, to meet this requirement. EUROPEAN PATENT CONVENTION The European Patent Convention is the treaty that established the European Patent Organization (EPO). The EPO grants patents that are valid in those member countries designated in the EPO application and subsequently perfected in those countries. Enforcement of the EPO patent is obtained through the national courts of the various countries. The software has been protected by copyright and excluded from patent protection in Europe. According to Article 52(1) of the European Patent Convention (EPC), European Patents shall be granted for any inventions which are susceptible of industrial application, which are new and which involve an inventive step. Article 52(2) excludes schemes, rules and methods for performing mental acts, playing games or doing business, and programming computers from patentability. Article 52(3) says that prohibition relates only to software as such. For Some years following implementation of the EPC, software in isolation was not patentable. To be patentable the invention in such a combination had to lie in the hardware. Then came a test case, EPO T26/86, a question of patentability of a hardware-software combination where hardware itself was not novel. It concerned patent for a computer control X-ray machine programmed to optimize the machines operating characteristics for X-ray procedures of different types. The patent office refused to patent the invention. Technical Board of Appeal (TBoA) disagreed and upheld the patent, saying that a patent invention could consist of technical and non-technical features ( i.e. hardware and software). It was not necessary to apply relative weights to these different types of feature. RECENT CASES 1.VICOM CASE The VICOM case has authority on what does mean computer Program as such and what constitutes a mathematical method. A technical effect can arise from an improvement in computer performance or properties or use of facilities such as a computer system with limited memories access stimulating better access by virtue of the computer programming. Decisions T935/97 and T1173/97 were followed elsewhere in Europe. The European Technical Board of Appeals of the EPO rendered two important decisions on the patentability of Business Methods Inventions (BMIs). Business Methods Inventions can be defined as inventions which are concerned with methods or system of doing business which are using computers or internets. 3. SOHEI CASE The Sohei case opened a way for a business method to be patentable. The patent was a computer system for plural types of independent management including financial and inventory management, and a method for operating the said system. The court said it was patentable because technical considerations were applied and technical problems were solved. Thus, the Technical Board considered the invention to be patentable; it was dealing with a method of doing business. The most widely followed doctrine governing the scope of patent protection for software-related inventions is the technical effects doctrine that was first promulgated by the European Patent Office (EPO). This doctrine generally holds that software is patentable if the application of the software has a technical effect. The EPO law regarding patentability of software tends to be somewhat more liberal than the individual laws of some of the EPO member countries. Thus, one desiring to patent a software-related invention in Europe should generally file an EPO application. INDIAN PATENT ACT Like in Europe, in India also the doctrine of technical effects governs the scope of patent protection for software-related inventions. The patent Act of 1970, as amended by the Act of 38 of 2002, excludes patentability of software per se. Section 3(k) of the Patent Act states a mathematical or business method or a computer program per se or algorithm is not patentable invention. The computer program products claimed as A computer program product in computer readable medium, A computer-readable storage medium having a program recorded thereon, etc are not held patentable for the claims are treated as relating to software per se, irrespective of the medium of its storage .On the other hand a contents display method for displaying contents on a screen, a method for controlling an information processing apparatus, for communicating via the Internet with an external apparatus, a method for transmitting data across an open communication channel on a wireless device that selectively opens and closes a communication channel to a wireless network, and each wireless device including a computer platform and including a plurality of device resources that selectively utilizes a communication channel to communicate with other devices across the network are held patentable though all above methods utilize computer programs for its operation. But computer program solely intellectual in context are not patentable. CONCLUSION In India software per se is not patentable. The inventions relating to the application of the computer program or software is held patentable under the Indian Patent Act, 1970 when claimed in combination of hardware and software components of a computer which provides a technical advancement over the prior art. It is necessary for the applicant to describe the technical contribution to the prior art when the invention involves software. The technical problem, which needs to be solved by the invention, should be sufficiently described as to how the hardware is controlled by the software to overcome the previously described problem. Is Immigration Reform Inevitable?

By Joseph Cella Recently, the subject of Immigration Reform has been making headlines with increasing frequency. However, many Americans are asking why, in the aftermath of September 11, 2001, would we even consider any sort of legalization program within U.S. immigration law. The short answer is that, with regard to both homeland security and our economy, it is in the best interest of our country. In fact, it is necessary. Most of us remember Section 245(i), which, between December 20, 2000 and April 30, 2001, allowed otherwise ineligible undocumented aliens in the United States to start the sometimes long process toward legalization. By way of letter to Congress dated May 1, 2001, President Bush expressed his intention to make 245(i) permanent. Then, during August and the beginning September 2001 Congress was in fact working on just that. However, when our nation was attacked on September 11, the issue of Legalization was dropped, and our government properly turned its attention to legislation which addressed our national security. However, the same issues that justified this administrations desire for immigration reform in 2001 did not evaporate. Rather, they have steadily increased in urgency. Although separate and distinct, the two go hand in hand with equal significance; homeland security and our economy. This Administration and Congress have increased governmental investigative powers with the enactment of the Patriot Act and related legislation. They have tightened our ports of entry with increased technology such as digital fingerprinting of entrants, and vastly increased criminal and terrorist databases. Although many reasonably believe that legislation such as the Patriot Act has undermined and eroded our personal liberties, it cannot be disputed that quite a number of terrorist plots against the United States have been foiled since September 11, 2001. However, such steps have been most effective against those attempting to enter or legalize in the United States. Those left are the 12 to 15 million individuals who are present in the United States with no avenue toward legalization. We know that they are not going to leave voluntarily as their numbers continue to increase. We also know that they are responsible for performing much of the labor that American Citizens are essentially not interested in doing. But who are they and how do we document them? This administration is acutely concerned about such a large segment of our population and workforce, about whom very little is known. Moreover, with the soon-to-be-realized mass retirement of the Baby boom generation, virtually every study confirms that the United States is headed for a severe labor shortage. That being understood by all, even if it were logistically possible, mass removal/deportation is simply not an option for our nation.
So what options remain? Legalization. Presently there are number of immigration reform bills in Congress, all of which address to varying degrees three basic plans; enforcement, temporary relief, and permanent relief. No matter what the final immigration reform legislation looks like, it will surely and properly include strong enforcement measures, as our continued failure to take control of our borders will certainly continue to undermine our homeland security and render meaningless whatever legalization/documentation measures we ultimately implement. As a result, we can expect significant increases in enforcement spending and border control. However, the issues of temporary and permanent benefits are not nearly as clear-cut as enforcement. For example, since permanent relief, a 245(i) type of program, would document the undocumented and secure an adequate labor force while raising vast funds for the Federal Government through the payment of penalties and filing fees, why is there even talk of temporary worker programs? Politics. A 245(i) type of legalization program would undeniably constitute amnesty, which, when uttered by any politician is the equivalent of political suicide. However, by implementing a temporary worker program, which, such as the working visas we have in place presently, does not lead to lawful permanent resident status, the word amnesty can easily and justifiably be avoided. After all, a program that ends after three or six years without affording the alien lawful permanent residence, is clearly not amnesty. So why not just have a temporary worker program? Business. U.S. businesses are understandably opposed to having their skilled and trained workers required to leave the United States, and their companies, every three or six years. This is especially true in the context of our upcoming labor shortage. As a result, permanent relief must be part of the reform package. Moreover, in the event that the ultra conservative interests are able to prevent the inclusion of permanent relief provisions in this immigration reform package, before the expiration of any three or six-year temporary program, permanent relief will be enacted. Furthermore, it appears that the foregoing has been clearly understood by this Administration and Congress since well before President Bushs Immigration reform Statement of January 7, 2004. In that statement, the President spoke of a Temporary Worker Program that would not be an amnesty, but, as he continued, would not preclude aliens from seeking lawful permanent residence though other legal channels. Translation: permanent relief. Additionally, earlier this year the REAL ID ACT was enacted. Among many other things, it made it illegal for any state to issue drivers licenses to individuals unless they can prove that they have legal status in the United States. At that time, eleven states were issuing licenses without requiring such proofs. Initially, the President was opposed to the READ ID ACT, as it essentially creates a national identification card. And, although those in favor if it say it does not do so as each state would have its own digital database of all its licensed drivers, the fact is that each state's database is accessible by every other state and the Federal Government, resulting in a national identification card. However, late in the game, the President became a supporter of the REAL ID ACT. Why? When the REAL ID ACT is fully implemented, no undocumented alien will be able to get a drivers license in any state. He or she will not be able legally drive, open bank accounts, deposit paychecks, transfer funds, travel by air, or by bus or train for interstate trips. As it is not in our national interest to either deport our workforce, or to deny our workforce the ability to function within our society, a legalization program is the only possible remedy. It is however in our national interest to deny such abilities to our criminal and terrorist undocumented population. To be sure, in order to legalize under any program every individual will be required to undergo extensive CIA, FBI and international security checks. Those who pass such checks will be permitted to legalize as they become documented. However, those who are felons, have terrorist ties, or are otherwise ineligible to become legal, will probably not participate in the program, or, if they do, will be deported. In the end, we will have a legally documented work force of individuals who have cleared deep security, background and criminal checks, with a far smaller group of criminal and/or terrorist undocumented individuals who will be essentially unable to function in our society due to their inability to secure legal identification, travel, or to open bank accounts and the like. Finally, any legalization program will require the applicants to pay a significant penalty (probably $2,000.00 each), in addition to the filing fees for applications that they could not otherwise file. Multiply those amounts by the number of applicants, and the amount of revenue raised will be in the trillions of dollars. So, considering the issues of homeland security, border control, maintenance of an adequate labor force, economic prosperity, and revenues to be raised, it appears that, in the absence of another catastrophic attack against the United States, significant and comprehensive immigration reform is inevitable. Dont be shy about speaking to these previous customers. 9. Find out whether the work was done on time and came in on budget. 10. Build a rapport with them and ask to visit the project in order to inspect the work first hand! 11. Do the inspection preferably without the contractor so you can ask sensitive questions. A. Did they finish when they said they would? B. Did they correct problems without a hassle? C. Did they respect your property and privacy during the course of the job? D. Did they honor their bid or ask for more money? 12. Do research on your own. NOTE: ASK FOR COPIES A. Contact the State Contractors Board to insure that they have a contractors license. B. Is their Contractors License up to date? C. Do they have surety bond? (In case the contractor splits with your money, you can collect.) D. Do they have adequate liability insurance? (damage to yours or your neighbors property -a min. of $1 million. E. Do they have workmens compensation insurance? (medical care/loss of wage, injured on you property) 13. Check the local Business Bureau for reports from a possible disgruntled client. 14. Check with the local police department. They may have a record of drug abuse and at times split with the funds, only to show up later back in business. 15. Never give them more money than can be accounted for in material and or labor expended on the project. 16. With every check you pay them, ask for a lien release for that amount. Especially, get a final lien release upon completion of the job. If they did not pay a vendor for materials used on your home, without a lien release that vendor can attach your house until you pay it (again!). 17. You should always insist on a written contract with detailed descriptions of the work to be performed. 18. Finally, do not forget to demand a reasonable time schedule and payment plan. By Angie Lewis What have you done lately to show the woman you married that you love her? Did you take her out to dinner? Maybe you bought her some flowers or chocolates? A man likes to do these things for a woman because its easy and fast. But is your wife really appreciating the flowers and chocolates? In this article I have mentioned a few other useful tricks you can do to show your wife that you love her. 1. Validate the woman you married A woman needs her man to validate her feelings. I know sometimes this is challenging for you to do, especially if you disagree with something she needs your support on. There is a correct way to do this without being offensive and hurting her feelings. First of all be understanding of your wifes feelings and then collaborate her on her thoughts and ideas even if they differ from yours. In essence, when you listen to your wifes feelings, without criticizing her, you have essentially given her the validation she needs. Everyone needs validation from time to time; it makes them feel useful and productive individuals. By trying to be more understanding, essentially you will be respecting the woman you married. Tell her how much you like her decorating style, or how she manages the home, or the way she dresses. Find the things about your wife you really like, be honest and tell her the great things you love about her instead of keeping those feelings inside. Validation is a form of acceptance that you can give your wife. By accepting her for the woman she is it will make her feel safe and secure being your wife. A woman who feels safe and loved will ultimately give more of her self to her man. Ironically, a husband can validate his wifes feelings better when he takes the role of spiritual leader in the home. A man who feels secure in his position is more likely to make his wife feel good about who she is in the marriage. They work better together as a team, accomplishing more for them selves and the marriage. 2. Be more Affectionate with your wife Hold your wifes hand while watching TV, taking a walk, or driving in the car. Massage her back or feet without asking for anything in return. Your wife likes to be touched and fussed over occasionally, know when that time is by being attune to your wifes feelings, and paying special attention to your wife on those days. 2. Surprise your wife with something totally unexpected Instead of golfing with your buddies on Saturday, take your wife to a romantic outside lunch if it is summer or fireplace lunch in the winter. Then take her to a romantic comedy matinee movie. If you have the money to spend, book a hotel room for the night with a Jacuzzi and enjoy the night together! Your wife will love all this. Make her a homemade all-occasion card on the computer telling her how important she is to you in your life. Make her feel special. Get creative, draw her a picture, and spend time on creating this card, she will love it that you took the time to make her a card rather than simply buying one from the store. It is the simple things in life that mean the most. 4. Give your wife the whole day off from cooking, children, and house cleaning. This isnt too hard. On your day off do everything for her. Do all the things she does for you. If you dont know how to cook, order pizza or Chinese food. Let your wife spend the day with her friends shopping or going to lunch, etc. When she comes home give her a back rub, take her shoes off, draw her a hot bubble bath and let her take a long bath. When she comes out from her bath, light the candles, caress her some more and just be there for her all the rest of the evening. Be her loving, romantic and protecting man so she can be the woman God made her to be for you. 5. Appreciate all that your wife does All of the above will show your wife that you love her and appreciate her for everything that she does. Being understanding of your wifes feelings and needs on a consistent basis will improve the quality of your marriage a great deal. By taking the respective roles that God has designed for each gender will greatly enhance the happiness of your marriage.
